A Clear Path Forward

A DOT drug or alcohol violation can put your safety-sensitive work on hold, but there is a defined process for moving forward.

Return to Duty SAP Services, LLC provides qualified Substance Abuse Professional evaluations for DOT-regulated employees and helps you understand what is required at each stage of the return-to-duty process.

You’ll receive clear information, professional guidance and respectful treatment from your first evaluation through your follow-up evaluation.

If You’ve Had a DOT Drug or Alcohol Violation

DOT regulations require you to be removed from safety-sensitive duties after certain drug or alcohol violations. Before returning to DOT-regulated safety-sensitive work, you must successfully complete the SAP return-to-duty process.

That process includes:

Initial SAP Evaluation

Your first step is an individualized evaluation with a qualified Substance Abuse Professional.

Education and/or Treatment

Your SAP will recommend the appropriate education and/or treatment based on your evaluation.

Follow-Up Evaluation

After completing the recommendations, you will meet with your SAP again to determine whether you have successfully complied.

Return-to-Duty Testing

Once your SAP determines you are eligible, your employer can arrange the required return-to-duty test. You must have the required negative drug test and/or qualifying alcohol test result before resuming safety-sensitive duties.

You Don’t Have to Figure It Out Alone

It is completely normal to have questions when you begin the process.

You may be wondering:

·         Where do I start?

·         How long will the process take?

·         What will my SAP recommend?

·         Can I complete the process if I am not currently employed?

·         How does the FMCSA Clearinghouse work?

·         What happens after I complete my recommendations?

Return to Duty SAP Services will explain your responsibilities and help you understand each next step.

For CDL Drivers

FMCSA Drug & Alcohol Clearinghouse

If you hold a CDL or CLP and are subject to FMCSA regulations, your return-to-duty process also involves the FMCSA Drug & Alcohol Clearinghouse.

Before your SAP can enter information about your return-to-duty status, you must designate that SAP through your Clearinghouse account. It is best to contact your SAP before sending the designation request so the SAP is expecting it.

Return to Duty SAP Services will report the two SAP-required entries:

·         Your initial SAP assessment date

·         The date you become eligible for return-to-duty testing

Your employer is responsible for reporting the negative return-to-duty test and completion of the follow-up testing plan.

Not Currently Employed?

You can still begin the SAP process even if you are not currently working for a DOT-regulated employer.

For FMCSA-regulated drivers, however, once you are eligible for return-to-duty testing, you will need an employer willing to complete the employer-controlled portion of the process. Owner-operators complete those employer functions through their designated C/TPA.
