Terms of Use
Effective Date: September 4, 2026
These Website Terms of Use (“Terms”) govern use of r2dsap.com (the “Website”), operated by Return to Duty SAP Services, LLC (“Return to Duty SAP Services,” “we,” “us,” or “our”). By accessing or using this Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. Website Information Only
The Website provides general information about Substance Abuse Professional (“SAP”) services, the U.S. Department of Transportation (“DOT”) return-to-duty process, and related services. Website content is provided for general informational purposes and is not a substitute for an individualized SAP evaluation, legal advice, medical advice, diagnosis, treatment, or advice from an employer, DER, MRO, testing provider, licensing authority, or government agency.
Rules and agency guidance can change. We may update Website content, but we do not guarantee that every page reflects every regulatory update at all times.
2. No SAP Relationship Created by Website Use
Viewing the Website, sending a general inquiry, or submitting a contact form does not by itself establish a SAP-client relationship or constitute an SAP evaluation. A professional relationship begins only after Return to Duty SAP Services confirms acceptance of the engagement and the required evaluation process begins.
3. No Guarantee of Return to Work or Timeline
Use of this Website or SAP services does not guarantee employment, reinstatement, return to a specific job, a particular education or treatment recommendation, a specific timeline, or a particular outcome.
The SAP determines whether an employee has successfully complied with SAP recommendations and is eligible to proceed to return-to-duty testing. Employers remain responsible for employment decisions and for employer-controlled portions of the DOT return-to-duty process.
4. DOT-Regulated Process
SAP services are provided subject to applicable DOT regulations, including 49 CFR Part 40 and applicable DOT agency rules. When federal requirements conflict with general Website content, the governing law and regulations control.
5. Confidentiality and Required Disclosures
Return to Duty SAP Services handles DOT drug and alcohol testing information and SAP records in accordance with applicable confidentiality rules. Certain information may be provided to an employer’s Designated Employer Representative (“DER”), DOT agencies, the Federal Motor Carrier Safety Administration (“FMCSA”) Drug & Alcohol Clearinghouse, the National Transportation Safety Board, safety agencies, or other persons when applicable law or DOT regulations authorize or require the disclosure.
Except where disclosure is otherwise authorized or required, individual drug or alcohol test information or medical information will not be released to third parties without the specific written consent required by applicable law.
6. General Contact Forms Are Not for Sensitive Information
Do not use the Website’s general contact form to submit drug or alcohol test results, medical records, diagnoses, medication information, treatment records, Social Security numbers, detailed substance-use history, or other highly sensitive information.
If sensitive information is needed for SAP services, Return to Duty SAP Services will provide instructions for an appropriate method of communication or document submission.
7. FMCSA Drug & Alcohol Clearinghouse
For FMCSA-regulated drivers, Return to Duty SAP Services may be required to report specified return-to-duty information to the FMCSA Drug & Alcohol Clearinghouse. The Clearinghouse is operated by FMCSA and is subject to its own terms, privacy practices, and federal requirements. Return to Duty SAP Services does not control the Clearinghouse or its systems.
8. Remote Evaluations and Technology
When remote SAP evaluations are offered, they are conducted only when permitted by applicable credentials and law and when the technology allows real-time audio and visual interaction with sufficient quality and security for the evaluation. Availability of remote services may vary by jurisdiction and circumstance.
9. Third-Party Websites and Services
The Website may link to government agencies, educational or treatment resources, scheduling services, payment processors, or other third-party websites. These services are operated independently and may have their own terms and privacy practices. A link does not necessarily constitute endorsement.
10. Intellectual Property
Unless otherwise noted, Website text, branding, graphics, logos, and original content are owned by or licensed to Return to Duty SAP Services, LLC. You may view and print Website content for personal, noncommercial use. You may not reproduce, publish, sell, or commercially exploit Website content without prior written permission.
11. Acceptable Website Use
You may not misuse the Website, attempt unauthorized access, interfere with Website operation, introduce malicious code, impersonate another person, or use the Website for unlawful purposes.
12. Website Availability
We work to keep the Website accurate, secure, and available, but the Website may occasionally be unavailable or contain errors. We may modify, suspend, or discontinue Website features at any time.
13. Privacy
Use of the Website is also subject to the Privacy Policy included below. Privacy and confidentiality obligations that apply to actual SAP services may be more protective or more specific than the general Website Privacy Policy.
14. Changes to These Terms
We may revise these Terms as laws, regulations, technology, or business practices change. The updated Terms will be posted on this page with a revised effective date.
15. Governing Law
To the extent not preempted by federal law, these Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
