SAP Support for DOT-Regulated Employers

Return to Duty SAP Services helps employers and Designated Employer Representatives navigate the SAP portion of the return-to-duty process with clear communication, required documentation and attention to DOT compliance.

1. Compliance Documentation

Return to Duty SAP Services provides the required written SAP reports following the initial and follow-up evaluations.

Reports are prepared in accordance with DOT requirements and sent directly to the employer’s Designated Employer Representative, or DER, with the information needed to document the employee’s progress through the return-to-duty process. DOT rules specify the required contents of both initial and follow-up SAP reports.

2. Communication With Employers and DERs

Clear communication is an important part of the SAP process.

Return to Duty SAP Services communicates directly with the appropriate employer or DER regarding required SAP recommendations, successful or unsuccessful compliance determinations, follow-up testing requirements and other information permitted or required under DOT regulations.

The SAP’s role remains neutral. The SAP does not advocate for either the employee or the employer, but instead serves the public interest in transportation safety.

3. Return-to-Duty Eligibility

After the employee completes the recommended education and/or treatment, a follow-up SAP evaluation is conducted.

If the employee demonstrates successful compliance, Return to Duty SAP Services provides the DER with the required written determination that the employee is eligible to proceed to return-to-duty testing.

The SAP determines eligibility for testing, not whether the employee returns to work. The employer makes the final employment decision and is responsible for arranging the required return-to-duty test.

4. Follow-Up Testing Plans

For employees who successfully complete the SAP process, Return to Duty SAP Services develops an individualized written follow-up testing plan and provides it directly to the DER.

DOT regulations require a minimum of six unannounced follow-up tests during the first 12 months of safety-sensitive duty. Additional testing may be required for up to five years, depending on the SAP’s professional determination.

The SAP determines the number and frequency of required tests. The employer determines the actual testing dates and is responsible for carrying out the plan.

5. FMCSA Clearinghouse Reporting

For CDL and CLP holders subject to FMCSA regulations, Return to Duty SAP Services completes the SAP reporting required in the FMCSA Drug & Alcohol Clearinghouse.

The SAP reports:

  • The date of the initial SAP assessment

  • The date the driver is determined eligible for return-to-duty testing

The employer or designated C/TPA remains responsible for reporting the negative return-to-duty test result and successful completion of the follow-up testing plan. The education/treatment recommendation and actual follow-up testing plan are not entered into the Clearinghouse.
